העתירה הוגשה ע”י האגודה לזכויות האזרח, בשמם, בשם מרכז “אדווה”, ובשם מספר מטופלים ממרכזי מתדון וסובוטקס שונים מרחבי הארץ.
העתירה מבקשת את תשובת משרד הבריאות ,מדוע המשיב לא יעביר את האחריות למתן השירות הניתן במרכזים לטיפול תרופתי ממושך בנפגעי סמים אופיאטיים (כלומר, מרכזי המתדון והסובוטקס) לידי קופות החולים, במסגרת רפורמת בריאות הנפש או בדרך אחרת.
עד להחלטת בג”ץ בעתירה, ממשיך צו הביניים להיות בתוקף, כלומר- המכרז שהוציא משרד הבריאות מוקפא.
